The International Court of Justice (ICJ) commenced a week-long series of hearings on Monday, focusing on the legal ramifications of Israel’s occupation of Palestinian territories. More than 50 states are set to present their perspectives before the judges during this significant event.

Background and Context:

The legal proceedings at the ICJ in The Hague were initiated following a request from the United Nations General Assembly in 2022. 

The Assembly sought an advisory opinion, a non-binding recommendation, regarding the ongoing occupation by Israel.

Palestinian Foreign Minister Riyad al-Maliki took the lead in presenting arguments at the hearings. Notable participating countries include the United States, China, Russia, South Africa, and Egypt. While Israel opted not to participate in person, it submitted written observations.

Current Situation and Urgency:

The hearings come amidst escalating tensions, particularly fueled by the recent battle between Israel and Hamas in Gaza. 

The situation, exacerbated by casualties and military responses, underscores the urgency of examining Israel’s conduct in the occupied territories.

Historical Context and Legal Framework:

Israel’s control over the West Bank, Gaza, and East Jerusalem, acquired during the 1967 war, forms the backdrop of the legal proceedings. 

The establishment of Jewish settlements in the West Bank and the annexation of East Jerusalem have drawn international scrutiny and criticism.

Scope of Inquiry and Previous ICJ Involvement:

The current inquiry encompasses various aspects of Israel’s policies, including occupation, settlement, and annexation, with a particular focus on Jerusalem. 

This marks the second time the ICJ has been approached for an advisory opinion on the matter, following the 2004 ruling against Israel’s separation wall.

While the outcome of the advisory opinion will not be legally binding, it holds significant moral and legal weight. It is expected to shed light on the legal status of the occupation and its consequences, potentially influencing future international actions and policies.

Separation from Genocide Case and Recent ICJ Decision:

The advisory opinion proceedings are distinct from the genocide case filed by South Africa against Israel at the ICJ. 

In late January, the ICJ ordered Israel to take preventive measures against genocide in Gaza, further highlighting the complexity of legal issues surrounding the conflict.
